प्रजातान्त्रिक शासन प्रणालीमा सूचनाको हकको महत्व पाँच बुँदामा स्पष्ट पार्नुहोस्।

Answer

The Constitution of Nepal 2072 (Article 27) and the Right to Information Act, 2064 guarantee every citizen the right to seek and receive information on matters of public importance. In a democracy it is important for the following five reasons.

  1. Transparency: Citizens can see how the government makes decisions and spends public money, which makes governance open.
  2. Accountability: Officials know the public can ask questions, so they are more answerable for their work and decisions.
  3. Control of corruption: Access to budgets, contracts and records exposes misuse of power and resources, discouraging corruption.
  4. Informed participation: Voters who know policies, plans and services can take part in elections, planning and monitoring intelligently, and so democracy becomes meaningful.
  5. Protection of other rights and trust: Information on services, benefits and laws helps people claim their rights, and it builds trust between the state and the people.

Hence the right to information is a pillar of democratic governance.

Clarify the dimensions of inter-provincial relations.

Answer

Dimensions of Inter-Provincial Relations

Under the Constitution of Nepal, 2072 BS, Nepal has three tiers of government (federal, provincial and local) and seven provinces. Provinces are autonomous but must cooperate with one another. Inter-provincial relations means the ties, coordination and cooperation among provinces for common functions and shared problems. Its main dimensions are:

1. Legal and constitutional dimension Article 233 requires provinces to maintain cooperation and coordination, and Article 234 creates the Inter-Provincial Council, chaired by the Prime Minister with the Home Minister, Finance Minister and Chief Ministers as members, to settle political disputes between the federation and provinces and among provinces. Provinces may also make agreements with each other within their powers.

2. Political and administrative dimension Provinces relate through their elected governments, chief ministers, provincial assemblies and parties. Coordination takes place through joint meetings, committees and consultation on policy, which keeps political harmony.

3. Economic and financial dimension Provinces share rivers, forests and minerals, receive grants and shared revenue, and cooperate in trade, tourism, hydropower, agriculture and industry. This reduces regional inequality.

4. Social and cultural dimension As Nepal is multi-ethnic, multi-lingual and multi-religious, provinces cooperate in protecting language, culture and identity, and in education, health and sports. Cultural exchange builds mutual respect and national unity.

5. Infrastructure and development dimension Roads, bridges, irrigation, transmission lines and airports crossing provincial borders need joint planning and cost sharing. Floods, landslides and epidemics ignore borders, so disaster management and environmental protection also need joint action.

6. Dispute-resolution dimension Disputes over boundaries, resources or taxes are settled first by mutual consultation and agreement, and otherwise through the Inter-Provincial Council and constitutional procedures.

Conclusion: Cooperative relations across these dimensions are essential for the success of federalism, balanced development and national unity.

फौजदारी न्यायका सामान्य सिद्धान्तहरु प्रस्तुत गर्नुहोस्।

Answer

Criminal justice deals with crimes and their punishment. Its general principles are:

  1. No punishment without law: A person can be punished only for an act that the law already declares a crime, and the law cannot be applied retrospectively.
  2. Presumption of innocence: Every accused is considered innocent until proved guilty by a competent court.
  3. Right to a fair trial: The accused has the right to a fair, open and impartial hearing by an independent court within a reasonable time.
  4. Right to legal counsel: The accused may consult and be defended by a lawyer of his or her choice, and free legal aid is provided to those who cannot afford one.
  5. Protection against double jeopardy and self-incrimination: A person cannot be tried and punished twice for the same offence, and cannot be forced to be a witness against himself or herself.
  6. Proportionate punishment: The punishment must match the seriousness of the offence, and torture or cruel and inhuman treatment is forbidden.
  7. Right to know and to be informed: The accused must be told the reason for arrest, and must be produced before a judicial authority within 24 hours (excluding travel time).
  8. Equality before law: The law is applied equally to everyone, regardless of caste, sex, class or position.
